Notification about arrest

Will anyone know that you have been arrested?

In Georgia when you are arrested for the alleged administrative offense, you have the right to ask the arresting officer to inform your relative, work or study place about your arrest and location.

In terms of the arrest for the alleged criminal offense the prosecutor or investigator is obliged to inform your relatives, education institution and/or employer about your arrest no later than 3 hours after the arrest.

If you are a foreigner, the arrest officer should inform the Ministry of Foreign Affairs of Georgia within 3 hours after your arrest. The ministry should immediately notify the embassy or consulate of your country about your arrest.

It is important to notify your relatives (or the embassy of your country), to make sure that they know about your whereabouts, that you are being held by the state authorities and, if necessary, assist you from outside.  They may also help you to find better legal aid to challenge your arrest or help in preparing your case.
