How long can detention on remand be applied as a security measure?
Trial within reasonable time
Human rights require that you be tried within a reasonable time or otherwise released whilst waiting for the trial. In Georgia, the time that you can be held detained is stated in the in the Constitution of Georgia and the Criminal Procedure Code of Georgia. Your detention must not exceed the time periods clearly stated in law. The detention period of the accused person should not exceed 9 months. Georgian legislation does not state any exceptions and the detention time cannot be extended for any reasons.
Reasoned decision
During the detention you have the right to apply to the magistrate judge for the change or annulment of detention as the restraint measure. Every time a magistrate judge keeps you in detention the decision has to explain and justify in detail why in your case specifically it is still necessary to keep you detained. If the decision does not give detailed and case-specific reasons, it may result in a violation of your rights.
